But when he was sitting in a packed lecture hall on Friday mornings\u2014learning about grapes, vintages, and <em>terroir<\/em> from legendary professor Vance Christian \u201961, MS \u201965\u2014he could never have suspected that 45 years later, he\u2019d become the global face of a key court case impacting the U.S. wine import industry.<\/p>\n\n\n\n<p>Schwartz\u2019s small, family-run firm, <a href=\"https:\/\/vosselections.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">VOS Selections<\/a>, was the lead plaintiff in a lawsuit that the <a href=\"https:\/\/libertyjusticecenter.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Liberty Justice Center<\/a> filed in the U.S. Court of International Trade in mid-April 2025, challenging the sweeping import tariffs instituted by the Trump Administration.<\/p>\n\n\n\n<p>In late May, a three-judge panel ruled unanimously in favor of the plaintiffs\u2014deciding that the tariffs had exceeded the scope of the 1977 International Emergency Economic Powers Act, under which the administration had instituted them.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote alignwide is-style-solid-color\"><blockquote><p>A three-judge panel ruled unanimously in favor of the plaintiffs\u2014deciding that the tariffs had exceeded the scope of the 1977 International Emergency Economic Powers Act.<\/p><\/blockquote><\/figure>\n\n\n\n<p>And while a federal appeals court temporarily halted the ruling two days later\u2014and the legal process is ongoing, potentially all the way to the U.S. Supreme Court\u2014the news instantly thrust Schwartz and his company into the international spotlight.<\/p>\n\n\n\n<p>For Schwartz\u2014an Arts &amp; Sciences econ major who\u2019s married to a fellow Cornellian, Cushla Naegele \u201980\u2014the media attention has been dizzying and unrelenting. He has fielded interview requests from just about every major U.S. newspaper and broadcaster, plus reporters from France, Italy, and beyond.<\/p>\n\n\n\n<p>But just days after the ruling, Schwartz was gracious enough to make time for a few questions from <em>Cornellians<\/em>. The following has been condensed from that conversation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading rkv-gutter-bottom-quarter\"><strong>Could you explain why tariffs\u2014which are intended to spur domestic industry by raising the costs of imported goods\u2014are so challenging in the realm of wine?<\/strong><\/h2>\n\n\n\n<p>Wine is not fungible. You can move a chip factory to Michigan, but you can\u2019t make Champagne in the Napa Valley. Wines\u2014especially the kind we\u2019re interested in\u2014are so specific to place, to culture, to the people there; it\u2019s all tied in.<\/p>\n\n\n\n<p>That\u2019s what makes wine interesting. Otherwise, you\u2019d have one red, one ros\u00e9, and one white, and they\u2019d all come out of a tap. What\u2019s so wonderful about wine is the difference.<\/p>\n\n\n\n<h2 class=\"wp-block-heading rkv-gutter-bottom-quarter\"><strong>Could you tell us about your business?<\/strong><\/h2>\n\n\n\n<p>Ours is a small, family company\u2014we\u2019re about 20 people\u2014that we started 39 years ago; first my mom worked with me, and now my 30-year-old daughter. We import from five continents. <\/p>\n\n\n\n<p>We sell wines, spirits, sakes, and alcohol-free products to a lot of lovely restaurants and shops in New York, New Jersey, and Pennsylvania. Our suppliers are also small, family operations. That\u2019s why this particular issue is so important to me.<\/p>\n\n\n\n<h2 class=\"wp-block-heading rkv-gutter-bottom-quarter\"><strong>Why were you willing not only to participate in this lawsuit, but become the lead plaintiff?<\/strong><\/h2>\n\n\n\n<p>There was really no option. I mean, we\u2019re all sitting around complaining about people not stepping up, and here was an opportunity to do something\u2014to put my money where my mouth is. I knew there were risks involved, but I felt I had to do it.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p> Here was an opportunity to do something\u2014to put my money where my mouth is. I knew there were risks involved, but I felt I had to do it.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading rkv-gutter-bottom-quarter\"><strong>What has your life been like since the ruling was announced?<\/strong><\/h2>\n\n\n\n<p>Lord, it\u2019s just been crazy. It\u2019s been a non-stop feeding frenzy on the part of the media. The level of interest is amazing. <\/p>\n\n\n\n<p>When the decision came down, we had press and people from all over the world contacting us, voicing their strong support, calling me all kinds of wonderful things. Of course, there were also some very nasty reactions\u2014but that\u2019s not a surprise.<\/p>\n\n\n\n<h2 class=\"wp-block-heading rkv-gutter-bottom-quarter\"><strong>Why do you think it has struck such a chord?<\/strong><\/h2>\n\n\n\n<p>People have found this very meaningful. We won a very important case in federal court\u2014decisively, unanimously, by a three-judge panel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading rkv-gutter-bottom-quarter\"><strong>Has there been a high point for you so far?<\/strong><\/h2>\n\n\n\n<p>Thursday [May 29] was such an intense day, and the media person for the Liberty Justice Center said, \u201cyou\u2019re on NPR at one o\u2019clock.\u201d I said, \u201cGreat.\u201d <\/p>\n\n\n\n<p>I didn\u2019t know who <a href=\"https:\/\/www.npr.org\/2025\/05\/29\/nx-s1-5415707\/a-small-family-run-wine-business-took-on-the-u-s-executive-branch\" target=\"_blank\" rel=\"noopener noreferrer\">the interviewer<\/a> was going to be\u2014and it turned out to be Mary Louise Kelly, who is my absolute favorite journalist. That was just a joy.<\/p>\n<\/div><\/div>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading rkv-gutter-bottom-quarter\"><strong>Lastly, since wine is at the center of this case\u2014what do you love about it?<\/strong><\/h2>\n\n\n\n<p>So many things, but I\u2019d really start with the people. Wine comes from the highest level of agriculture; to grow wine grapes, you\u2019re always pushing the limit of your <a href=\"https:\/\/www.wineenthusiast.com\/culture\/wine\/does-terroir-matter\/?srsltid=AfmBOook-nknW6Vd8A3Jnmk4v3w3avXFkeY6msxPXEI2P2zD3UzZuxg6\" target=\"_blank\" rel=\"noopener noreferrer\"><em>terroir<\/em><\/a>. So you have to really believe in what you\u2019re doing.<\/p>\n\n\n\n<p>These are incredible craftspeople who have incredible palates, and they\u2019re very tied into their cultures\u2014especially in Europe, because wine there comes from such a long, old culture.<\/p>\n\n\n\n<p>I could go on and on, but the short answer is: it\u2019s humanity meeting nature.
